showdown. and heat relief in the forecast today. 60s and 70s for the coast and a major drop ahead. i'm tracking highway 92 over the water and in the hills. a new incident reported in lanes in the highlands, coming up. san francisco's marina district. on this wednesday october 3rd. this is "today in the bay." good morning to you. thanks for being with us. it is 6:00. i'm marlo tellez. >> i'm jon kelley. we're following developing news in the east bay. fire investigators say there's so much damage to a home that burned in berkeley early this morning, they're now in the process of trying to clear out some of that debris before crews can go inside to find out what started it. this happened at benevenue

avenue. that is where "today in the bay's" christy smith is. she's on the scene there, live with the details. good morning. >> reporter: good morning. right now berkeley firefighters are on fire watch. the good news is basically this fire is out. but when they arrived, there were flames pouring out of the back of the home. one of the first concerns is pretty obvious. these are big older homes. they're very close together. two other serious concerns is of course making sure everyone is out of the building. also, the integrity of the building. there was a partial collapse of the roof and the second floor. this started about 12:19 this morning in a duplex. this functions as a single family home. one family lives here. firefighters had to go in a defensive mode and fight the flames from the outside of the building. they used water and houses and

ladder trucks here. there was also concern about this spread to other buildings. that meant neighbors had to evacuate. >> fire was threatening adjacent structures to the rear and the side of the building. we also had a rescue in which berkeley police officers helped remove a woman who was in a wheelchair. there were four other occupants able to get out of the building. >> reporter: he said the fire, the policeman who helped that woman in the wheelchair get out, he considers them heroes. everyone okay. no injuries to report. the red cross is helping the five people who live in the home, they're at a nearby hotel. building inspectors should be here by day break to check the duplex. they're concerned because essentially the rear of this home is gone and they may have to excavate, get some of the debris out of the way, and they're really concerned about

the structural integrity. they say they will prefer to do all that sort of work when they can really see what they're doing at day break. damage is estimated in the hundreds of thousands of dollars. i asked the deputy chief there about the reports that a propane tank might be the cause of this fire. he said at this point, it's something they're looking at, but they just don't know. reporting live in berkeley, christy smith, "today in the bay." a man remains hospitalized after being shot. at this hour, police still searching for whoever pulled that trigger. officers say it all happened about 11:30 on ezie street, not too far from center road. the victim, good news, is expected to survive. so far, nobody is under arrest. police still have not released a description of a suspect. the body of a second fisherman missing since sunday has been found on a beach north of pigeon point. the man is one of four friends from san francisco on a boat

that capsized near half-moon bay. two of the four men were wearing life jackets, and they survived and were able to swim to shore for help. the body of the first missing man washed ashore monday. the coast guard says the two men who died were not wearing life jackets. no signs of a missing san jose man who was last seen leaving a friend's house on a harley. relatives and friends praying last night for eric garcia's safe return home. police say they're looking at a missing person's case here. garcia's brother says he felt something was wrong when garcia did not show up to work the next day. >> i understand anyone going through something like this is just horrible. the family has confirmed 32-year-old garcia is a member of the motorcycle club. at this point, police have yet

to reveal whether they believe foul play was involved. garcia's family says he does have a heart condition and does not have his medication. dozens of angry protesters took over the city council meeting in oakland last night demanding to know more about a deadly police shooting five months ago. the family and about 75 supporters of 18-year-old allen blueford packed the chamber. the family was finally given a copy of the official police report. something they say they have been asking for since the shooting. blueford was shot and killed back in may after police say he tried to run away from them. at first police said he had been killed in an exchange of gunfire that injured the officer. they later said that while a gun believed to be blueford's was recovered, it had not been fired and the officer's wound was self-inflicted. the district attorney and

oakland police are still investigating this shooting. that protest comes as a federal report comes to light, accusing oakland police of being too quick to pull that trigger. a monitor tracking police reforms in the city says officers sometimes shoot at suspects even though they may not face immediate danger. the monitor says officers may be hypersensitive to the dangers of their job. also quoted as saying detectives appear to be, quote, predisposed to the position that the shooting is justified. he goes on to say that officer-involved shooting investigates, quote, appear to be cases that exhibit the most deficiencies and the least inquiztivene inquiztiveness. the head of the union tells the "chronicle" our officers see more violence a shift than many officers in america see in an entire year. 6:06. a controversial plan to outsource police will now be left up to voters. in a packed meeting, the council

decided voters should be the ones to decide if malpetis should contract out police services to the department. they will vote to put that plan on the ballot. the gates will be locked at san jose's alum rock park. a safety measure here. fire officials say they're still -- there are still extreme fire conditions due to the hot weather. if that weather manages to cool off, the city plans to reopen the park. in fact, meteorologist christina lore be says it is going to cool off a bit. let's get a check of the forecast now. it is going to cool off substantially as we head to the end of the week. good morning. want to start with a live look over san jose. clear conditions. it's going to be another hot one. want to talk about the really hot spot. the most substantial record i can point out is hayward. 94 degrees. smash the record of 80 that was

set in 2009. so what happens is we hit 80 degrees at about 11:00 but that mercury kept on rising. very unusual to be dealing with that for the first week of october. temperatures came down. records fell all over the place. and they're going to drop off as we head through this afternoon. we're at 59 in fairfield. headed towards a comfortable day. look at this. 74 degrees in pleasanton. it's going to take one day for that warm air to mix out. an area of low pressure arrives, brings us back low cloud cover. you will notice a difference, especially tomorrow morning. 75 degrees at the coast. seven-day outlook is critical if you're trying to make those weekend plans. we'll have that for you in my next report. want to check the drive with mike. >> we've been tracking the bridge. smooth over on the hayward side. on foster city approach as well. a nice easy drive approaching

92. we do see some slowing at the interchange. it's for southbound 101. construction between hillsdale and 92, both directions, this may be the result of the crews clearing from the southbound side. we also have at 280, that interchange, now there's a report of a deer hit possibly killed in lanes there and that will be an issue for local traffic passing through the interchange. prepare for a little traffic control or traffic break. we'll give a live look outside. we look at the cash lanes. expecting metering lights in about five minutes. berkeley, open, completely open to traffic flow. that's good news. back to you. >> okay, mike, thank you. 6:09. now to decision 2012. take a look at this new video. where the stage is already set for the first presidential debates of this campaign. this morning, president obama and republican rival mitt romney are putting the finishing touches on their key talking

welcome back. a quick check of today's top stories. firefighters still trying to figure out exactly what caused the fire that just gutted a home in berkeley. it burned for several hours. the five people inside fortunately were able to get out safely including one woman in a wheelchair who had to be rescued by police. a new federal report puts oakland's police department in the spotlight. the report says officers may be shooting at suspects even when there's not an immediate threat. the head of the officers union responded saying oakland police

face more danger than officers in most other cities. you probably noticed the hot temperatures across the area. san jose's alum park is closed for a second straight day due to fire danger. yesterday, temperatures hitting the 90s in a lot of cities. triple digits inland. who's ready for fleet week? the blue angels in the area skies this weekend. the famed pilots touched down yesterday in formation of course. they will be practicing tomorrow for their air show over the weekend and san francisco. >> that will definitely be cool. looking forward to that. the blue angels will share the area with america's cup this week. the world's best sailors getting back into action for another round of the world cup series. >> we are live in san francisco with more. good morning. >> reporter: good morning. we're actually on pier 30/32 in the racing hut.

30/32, "today in the bay." >> the owner of the oracle yacht team is opening up to cnbc about what he plans to do with a hawaiian island he just bought. larry ellison says he wants to turn lanai into, quote, a little laboratory. he says he's going to convert seawater into fresh water on organic farms that he hopes will be exporting organic produce to japan. side note, also telling cnbc he would love to own the l.a. lakers one day. the lakers happen to be his favorite basketball team. >> scott ellison could afford the lakers. >> he's a very rich man. ellison in addition took out a $4 billion -- that's billion dollar -- credit, line of credit recently from the bank using stock. which means he could anytime he wanted to write a check for $4 billion. i'm sure that would be plenty to buy the lakers. meanwhile, other news. a woman suing venture capital

firm kleiner perkins for sexual harassment says this morning she's been fired. the firm says she wasn't. she says she was terminated, told to clean out her office on monday. she's in the middle of that lawsuit against the firm. in a statement this moring, kleiner perkinses says the woman's still an employee but is being, quote, transitioned from the company. you can say the woman's picture and buyography are still on the firm's website. a computer programmer has written a scathing blog post against his employer complaining of companywide racism. it's a small company. we're not going to name it because the blogger's not using his real name. it has quite a few people talking this morning. the man who is black, worked as a contract employee and complained to his boss who allegedly told him no, you're just too sensitive. that's the problem. i acknowledge, the boss said, that racism happens out there in the world, but racism doesn't happen in this office. the company says it takes the

allegations seriously and is investigating. as for wall street, t mobile, metro pcs talking about merging. a private payroll company predicting america gained 160,000 jobs last month at least in the private sector. we'll get the real numbers on friday from the labor department. as a general rule of thumb, you can expect the labor department will say less than 160,000 because they've got to take in government jobs as well. lately, that's been a subtraction. back to you. is it going to start to feel like october? let's talk about that. >> it's going to feel like december, yeah. after it felt like -- we've been calling it "augtober." feeling more like august than october. highs yesterday, whoo, they were so warm. 107 in gilroy.

current temperatures now, it is crisp out there at 6:19 in the morning. 62 degrees up in santa rosa. we head throughout the day today. we will see a return of the marine layer. cloud, yeah, the low clouds that have been missing for the past 72 hours, they return. as a result, your temperatures drop like a rock. so, what's ushering in that flow? we've got an area of high pressure which will bring about major changes. low pressure system arrivings. best chance for that will be in the north bay over the course of sunday into monday. winds will shift out of the west. that will bring about a 20 to 25 degree drop. your temperatures return. the patchy fog, the drizzle, is back. these numbers today will be even cooler tomorrow. as we get into your weekend, take a look at this. 94 in livermore. 78 in san francisco. 77 in santa cruz. if you want to hit the beach, you've got one more great day to do so.

of people naked in san francisco now. that's the only way you can keep cool with overnight lows in the 60s. want to start with a beautiful picture over san jose. mostly clear here. it's mostly clear own san francisco as well. temperatures are going to be at 68 degrees inland as of 8:00 a.m. 93 degrees at 4:00 p.m. normally, i'd talk about how this is above average. compared to yesterday, it will be cool. if you've got tickets to see the a's, the final game of the regular season, 77 degrees at 2:00 p.m. even though we're the giants station, we still want the a's to make it. we'd love a bay bridge series. >> we'd love that challenge. we hope also that folks are not challenged too much by that postgame traffic. keep that in mind, past the coliseum. we'll show you the maps. now starting to build on all these surface streets as folks are heading to the freeways.

people buy computers. suffered under a string of controversial ceos. it's one of the oldest companies in the valley but has been eclipsed by google and apple. more job cuts announced today are not impossible though hp has not completeled its last round of job cuts. let's go back to why we pay so much attention. we talk about apple being the most valuable company in america and that's true but hp from a revenue standpoint is much bigger. hp made 120 billion. hp kind of old, but boy is it big. >> indeed it is, thank you very much. now to decision 2012. tonight, president obama squaring off with republican rival mitt romney for their very first debate. this one, a very tight race. a lot at stake. romney does have momentum

heading into this one. the president's among those likely to vote. the stage is set, ready to go for a big-time throwdown. >> reporter: the big question, what has been going on behind closed doors? how are these candidate, getting ready? apparently, the aides are helping president obama keep his answers a little bit short so he's not long-winded. also, focus more on being aggressive. for mitt romney, he is focusing on not appearing irritated when he's challenged by the president, which is sure to happen. all of this as the stage is set. the president went to hoover dam. mitt got some lunch here in the

clear san francisco. this is the last morning of perfect visibility here. as of tonight, the fog rolls back in. as of tomorrow, we're talking about mostly cloudy conditions. all the way through the extreme east bay. 54 degrees. close to 65 degrees throughout most of your south bay cities. even in the 70s in pleasanton. that's the case for you as well. hour by hour forecast works like this. by noon today, low 80s as opposed to the 90s we experienced yesterday. and it's about ten degrees cooler. 80 degrees, bay side. 75, at the coast. hold on if you can. i've got that seven-day forecast coming in my next report. there is so much happening around here. major changes to the forecast. >> pretty rapid changes over here for the commute. the volume really kicking in. here's the bay bridge. making its way back to the maze

in the berkeley curve. the freeway still moves smoothly. we see the san mateo bridge approaching the peninsula. i want to show you the map. we see the slowing as we approach the interchange. south 101 slows. down in towards third, popular, where there's some late construction work. that's a problem. 280, very clear. we'll watch this for clearing as well, guys. back to you. san mateo county getting the word out about a change to the monthly tsunami warning test. officials will conduct a full volume test of the sirens. a low volume test is usually what they do on that first wednesday of every month. today, that test will be louder and last longer. the sirens will sound for about two minutes in order to reach

if it's been too hot for you, here's the silver lining. just a picturesque perfect shot. marlo, remember the show -- >> the love boat? >> yeah, love boat, shiny and new, it's gorgeous out there. we're going to cool off a little bit. it is 6:40. the search continueses for a gunman who shot and killed a border patrol agent. investigators combing the area along the border. the fbi at this point is not saying if it's found any weapons at that crime scene. agents say they believe the shooter may not have acted alone. early yesterday morning, agent nicholas ivy was gunned down while on patrol. a fellow officer was also wounded in that scene. agents originally responding to a trigger that was triggered out

in that area known for drug trafficking. a key figure in the jerry sandusky scandal is suing penn state university. mike mcqueary filed a whistle blower lawsuit yesterday. he claims his treatment by the university after the arrest of sandusky last year caused him distress, anxiety, humiliation and embarrassment. he is seeking millions of dollars in damages. back in 2001, mcqueary says he witnessed and reported child abuse. it is 6:41. coming up, an east bay home reduced to rubble as residents run from their beds trying to escape all the flames. we'll look at how all the people made it out to safety. and how firefighters kept the flame from spreading to neighboring homes.

welcome back, everybody. it is 6:44. activists planning to rally in richmond demanding safety improvements. richmond city council passing a resolution demanding chevron update its equipment. it also wants the company to increase its financial support and hiring in that community. just last august, this past august, one of the refineries pipeline ruptured, releasing that large huge vapor crowd. it ignited and caused a big massive fire causing toxic fumes. oakland is officially the first city in the nation to offer residents combination government i.d.s and bank cards to all citizens regardless of immigration status. city council members voted to

give the plan a final go-ahead during last night's session. all oakland residents can prove -- who can prove their identity can get a card. what makes the i.d. unique, the debit card function lets lower-income people avoid check cashing fees and keeps them from having to carry cash. city leaders say the program will take 60 to 90 days to roll out. the price will be a one-time fee of $10 for minors and seniors and $15 for adults. richmond is now considering a similar program. the sign of a tough economy. the alum rock union school district says it's eliminating 18 teaching positions and it's planning to combine dozens of classes. this is in an effort to cut down on spending. the district says these moves will help save them more than $1 million. school officials blaming shrinking enrollment will reduce the amount of funding from the state. alum rock park in san jose

is open, passing 92, but watch for flashing lights. the south bay. northbound routes really kicking in. 101 into sunnyvale. slow all the way to san jose. 85 and 87, good slowdown. from 87 to saratoga, there's your pattern that's developed. looks like it's here to stay. live looks outside show you 880 through freemont. that's where the volume really starts to build. oakland also shows slowing. a big backup there, guys. >> lots of backups today. 6:49. developing news in the east bay this morning. a house fire that destroyed a home in berkeley. it happened on benvenue avenue in berkeley. not far from the intersection. at the damage. >> good morning. we moved in front of the house. you could get a better look at the damage to this home along the side and the back. you can see, there was a partial collapse of the roof and the second floor. a rolling house fire. we do have that new video shot by a neighbor i spoke with. flames pouring from the home. there were five people inside at the time. they made it out except for one woman who was in a wheelchair. she had to be rescued by police. they were among the first people on scene. the house -- the houses here are so close, they had to be evacuated. firefighters had to go into defensive mode so no one would get hurt. they're telling me they're going to have to excavate the back of the home, remove debris. they're concerned the home in the back there could collapse even further. good news, no one was hurt. damage estimates in the hundreds of thousands of dollars.

there were reports that propane tank may have something to do with the cause of the fire. i spoke with a deputy fire chief. he says he has heard that but at this point can't confirm it. >> a scary scene. a san francisco woman manages to wrestle away from a man after she wakes u right in the middle of a sexual assault. the suspect remains behind bars. police say more victims could be out there. san francisco police say martin van yecky met a couple at a bar in the sunset district and drugged them both after they invited him back to their home. police say the suspect sexually assaulted that woman while she was pass the out. the suspect then ran off after the woman woke up and managed to finally get away from him. police say the man had given the couple his cell phone number before that assault. officers were able to trace the number and they arrested him. new charges against a man accused of trying to kidnap a girl from an elementary school.

his booking photo has not yet been released. he was already facing several charges relating to a kidnapping case at parkside elementary last week. now, he's facing another 18 counts for allegedly hiding in a daly city elementary school bathroom back in march. the teacher who confronted the intruder that day identified him as the culprit. he's due back in court to enter a plea october 10th. a woman suing her own venture capital firm in silicon valley says she has now lost her job. tech news sites all things d reports ellen powell said online she'd been fired from kleiner perkins on monday. powell was a junior partner at that firm. she filed a lawsuit claiming senior partners failed to stop a collide from harassing her after she broke off a relationship with him. she claims the firm was biased against women, a claim the firm

denies. a judge denied kleiner perkin's request to try to solve that case through arbitration. ceo of hp meg whitman facing her critics this morning. >> she's been at hp for a year. which by their standards is a long time. will hold an analyst conference today. whitman will have to lay out what she sees as the future of hp. they've been eclipsed by companies like apple but, remember, still a huge important company from a revenue standpoint. hp, biggest tech company in the world. this is unusual. new data show not only is samsung selling a heck of a lot of phones, apple isn't slowing it down. not only did samsung see sales spike after the introduction out iphone 5. apparently all the talk about
